Use of the site
Eligibility
By accessing or using 55 Club at 55clubapp.com.co, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and are not prohibited by applicable law from using this site. If you do not meet these requirements, you must discontinue use immediately.
Permitted use
You may access and use 55 Club solely for lawful, personal, non-commercial purposes. You agree not to attempt unauthorised access to any part of the site or its servers, introduce malicious code such as viruses or logic bombs, scrape or harvest data without our prior written consent, or reproduce any portion of the site for commercial gain. Transmitting unsolicited advertising, spam, or promotional material to other users is also strictly prohibited.
Account responsibility
If you create an account on 55 Club, you are solely responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. You must notify us immediately at [email protected] if you suspect unauthorised use. We reserve the right to suspend or terminate accounts that breach these Terms of Service without prior notice where the breach is serious or repeated.
Intellectual property
Ownership
All content published on 55 Club, including text, graphics, logos, icons, images, audio and video clips, data compilations, and software, is the property of 55 Club or its licensed content providers and is protected under applicable copyright, trademark, and intellectual property laws of India and relevant international conventions. Unauthorised use of any such material may give rise to a claim for damages or constitute a criminal offence.
Limited licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the site for personal, non-commercial purposes only. This licence does not permit you to copy, republish, or distribute site content without our express written permission, modify or create derivative works from any site content, use the 55 Club name or logo without prior written authorisation, or frame or mirror any part of the site on another server or internet-enabled device.
User-submitted content
If you submit reviews, comments, or feedback to 55 Club, you grant us a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, publish, and distribute that content in any media. You represent that you own or control all rights in the content you submit and that it does not infringe any third-party rights. We reserve the right to remove any user-submitted content that we determine, in our sole discretion, to be unlawful, offensive, or in violation of these Terms.
Limitation of liability
No warranties
55 Club is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.
Exclusion of damages
To the fullest extent permitted by applicable Indian law, 55 Club and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the site. This includes, without limitation, loss of data, loss of revenue or profits, loss of goodwill, or any damages resulting from reliance on information obtained through the site, whether the claim is based in contract, tort, statute, or any other legal theory.
Cap on liability
Where liability cannot be fully excluded under mandatory provisions of Indian consumer protection or information technology law, our total aggregate liability to you shall not exceed the greater of INR 500 or the amount you paid to us in the thirty days immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability for fraud, wilful misconduct, or death or personal injury caused by our negligence.
